Actually, I believe Lex did ask to take part in negotiations, which were taking place since the guy was demending a helicopter. And "Don't hurt them" sounds a lot more like something you'd hear in negotiations than an order to people you hired. I doubt Jonathan would've jumped to the same conclusion if he overheard anyone else saying it.
